Louis Vuitton Malletier claims to hold a luxury brand under which they manufacture and sell goods. The plaintiff filed this complaint after discovering in January and November 2022, that its copyrighted photos were being misused by Defendants 1 and 2 to sell their products on their official website www.haute24.com. The complaints regarding Defendants 1 and 2 claimed that the photos of the plaintiffs were used without permission. Also, it claimed that the Defendants had no economic relationships or permission with the plaintiff to use or disseminate the photos, whose unlicensed use amounted to copyright infringement.
The complaint sought a permanent injunction against Defendants 1 and 2 and their agents or servants from duplicating, copying, or disseminating the infringing images or any other work infringing the plaintiff’s copyright. It was added by the Bench that the plaintiff made out a clear prima facie case of copyright infringement, which would be entitled to ex-parte ad interim relief so that such kinds of infringements do not continue. Accordingly, it let the plaint be registered as a suit and issued a summon on it.
